Solaris 10は無償のOSではなくなってしまった！ #solaris #sun #oracle

@ryiwo さんのつぶやきにリンクされていた記事をキッカケにあれこれ調べてみたら、どうにも残念ながら、本当にSolaris 10は無償でなくなってしまったと確認した。

キッカケになった記事では:

Solaris 10, the official stable version of Sun's UNIX operating system, is no longer available to users at no cost. Oracle has adjusted the terms of the license, which now requires users to purchase a service contract in order to use the software.

SunのUNIX OSのStableバージョンであるSolaris 10は、無償では使えなくなってしまった。Oracle社はライセンス規約を変更し、ソフトウェアの利用にサービス契約を要求するようにした。

この記事の後半では「Solaris 10にお金を払いたくないならOpen Solarisに移行すればいいじゃない」, 「無償のLinuxと有償のSolarisの日本柱って考え方はそれなりに合理的」みたいなコトを言ってくれているけれど、企業ユーザとしてはとんでもな い話である。例えばCADのワークステーションで使ってたりすると、台数も多ければ検証も間に合わない。(個人的にOpenSolarisは良いOSだと 思うけどね、ただそれとこれとは別問題でさ)

そんなわけでどうしても信じられず(信じたくなく)、しつこくSolaris 10のライセンスアグリーメントを確認したのだけど:

2. License Grant and Entitlement.

Subject to the terms of your Entitlement, Sun grants you a nonexclusive, nontransferable limited license to use Software for its Permitted Use for the license term. Your Entitlement will specify (a) Software licensed, (b) the Permitted Use, (c) the license term, and (d) the Licensed Units.

Additionally, if your Entitlement includes Services, then it will also specify the (e) Service and (f) service term.

If your rights to Software or Services are limited in duration and the date such rights begin is other than the purchase date, your Entitlement will provide that beginning date(s).

The Entitlement may be delivered to you in various ways depending on the manner in which you obtain Software and Services, for example, t he Entitlement may be provided in your receipt, invoice or your contract with Sun or authorized Sun reseller. It may also be in electronic format if you download Software.

2. ライセンスの供与とEntitlement

「Entitlement」の条件を遵守する事で、Sunはユーザーにソフトウェアを利用許可する非排他的な移管不可能な限定的ライセンスをラ イセンス条 件で許可された利用目的で利用する事を許可する。ユーザーの「Entitlement」では a)ライセンスを与えられたソフトウェア b)許可された利用 c)ライセンス条件 と d)ライセンス単位を特定する。

さらに、ユーザーの「Entitlement」にサービスが含まれる場合には、 a)サービス と b)サービス条件 も特定される。

ソフトウェアも しくはサービスへのユーザーのEntitlementが、期間限定されており、そのようなEntitlementが開始された日にちが購入日以外である場 合には、ユーザーの「Entitlement」には開始日が含まれる。

「Entitlement」はユーザーがソフトウェアとサービスを入手した方法により、異なる方法で届けられる事がある。例えば、 「Entitlement」はSunもしくはSunが権限を与えた再販業者の 領収書、請求書、もしくは契約書で提供される事がある。ユーザーがソフトウェアをダウンロードした場合には、電子フォーマットで提供される事もある。

こんな具合で、どうやら「Estitlement」なるものでライセンスの種類が規定される(その中で例えば評価版がどうとか、期間限定がどうと か、が記載されるらしい)ようだ。ただ、今日の午後 13:00前後にSolarisをダウンロードしたもののEntitlementは届かない。

届かないのが気持ち悪くて他の文書も確認したみたところ:

Obtaining an Entitlement Document is simple. On the Solaris 10 Get It page, select the platform and format you desire from the drop-down menus, and then click the Download Solaris 10 button. When you arrive at the Sun Download Center, either sign in or register, ensuring that a valid e-mail address is part of your Sun Download Center account to receive the Entitlement Document. Fill out the Solaris download survey, specifying the number of systems on which you are installing the software. Once you have completed the survey, you will be redirected to the Solaris 10 download page for downloading, and your Entitlement Document will be sent to your registered e-mail address. Please remember, your right to use Solaris acquired as a download is limited to a trial of 90 days, unless you acquire a service contract for the downloaded Software.

Solaris 10をダウンロードされたお客様へ

Entitlement文書の取得は非常にシンプルです。「Solaris 10 Get It」のページで、プラットフォームとフォーマットをドロップダウンメニューから選択し、「Download Solaris 10」ボタンをクリックします。Sun Download Centreでsign-inするか、アカウントを作成しEntitlemnet文書を受け取るためのe-mailアドレスを登録してください。 Solaris downloadのアンケートで、インストール対象の台数を記入ください。アンケートの記入が終わると、Solaris 10 donwloadページにリダイレクトされ、あなたのアカウントに紐づいたe-mailアドレスにEntitlement文書が送られます。ダウンロード したSolaris 10はサービス契約を結ばない限り、90日間のトライアル用途に限定されることをお忘れなく。

と、このようにある。つまり、Solaris 10はサービス契約を結ばない限り、90日以上は使えない。

さて、問題は適用範囲がどこまでに及ぶか。つまり:

• すでにインストールされているものは、改定前の条件(つまりサービス契約を結ばずとも使える)が適用されるのか？
• プリインストールモデルを購入した場合、やはりサービス契約を結ばないとSolaris 10をアンインストールしなければならないのか？

このあたり。この辺の機微はもっと文書を追っかけていかないと見えないみたいなので、お付き合いのある営業さんに聞いてみなくちゃなぁ。むー。

……しかし、こんな感じで元Sunのプロダクトが、ずいずいOracleの流儀に染められて行くとしたら、ホントに輝きを失っちゃうよなぁ。
